A class action lawsuit has been filed against Carnival Corporation on behalf of the passengers aboard the Triumph.

Filed earlier this week in the Southern District of Florida by Matt and Melissa Crusan, who were passengers aboard the ship, the lawsuit alleges that Carnival “allowed a hazardous condition to exist on its vessel which it knew or should have known was likely to cause injury, harm and damages to its passengers.”

It continues: “At all times material, due to the negligence and/or gross negligence and/or intentional conduct of the Defendant, Plaintiffs and all others similarly situated were placed in an immediate risk of physical harm.”

The filing also points to the towing to Mobile (as opposed to Mexico) claiming that it was “motivated solely by financial gain and Carnival’s convenience.”

Three counts were brought against Carnival: Negligence, Negligent Infliction of Emotional Distress, and Intentional Infliction of Emotional Distress.
